The terms that apply to the organizations and people who use Paqad.
Last updated:
These terms govern the use of Paqad, an online platform that churches and similar organizations use to run their work. Paqad is provided by OmniCore Systems Consulting LTD, registered in England and Wales ("we", "us", "our").
An "organization" is a church or other body that uses Paqad. A "user" is a person who signs in; a user works in Paqad only as a member of an organization that invited them, and on its behalf. If you accept these terms for an organization, you confirm that you are allowed to do so.
By creating an account or using Paqad you agree to these terms. Please also read the Privacy Policy, which explains how personal data is handled. If you do not agree, do not use Paqad.
You must not:
If you find a security weakness, please tell us at privacy@paqad.online and do not exploit it.
Each organization is responsible for:
Each organization owns the records it puts into Paqad; we claim no ownership of them. Users with the right permissions can export the organization's main records as spreadsheet (CSV) files at any time.
We handle those records only to provide Paqad to the organization and on its instructions, as its processor, and we protect them as described in the Privacy Policy, using only the service providers listed there. An organization that needs a separate data processing agreement can ask us for one.
Paqad is provided "as is" and "as available". We work to keep it running and secure, but we do not promise that it will always be available, uninterrupted or free of errors. We may need to pause it for maintenance or to deal with a security problem.
We may change, add or remove features. If a change significantly reduces something an organization relies on, we will tell it in advance where we reasonably can.
We may suspend an account, or an organization's access, if these terms are seriously or repeatedly broken, or where that is needed to protect the service, its users or others. Where appropriate we will explain why and give a chance to put things right.
Paqad is currently provided without charge, unless a separate written agreement between us and an organization says otherwise. If we decide to charge in future, we will tell organizations in advance, and no one will be charged without agreeing to it.
The Paqad software and its design belong to OmniCore Systems Consulting LTD or its licensors. You may use them only to use the service under these terms. The records and files an organization puts into Paqad belong to that organization, which allows us to store and process them only to provide the service to it.
Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded by law.
Subject to that, and to the extent permitted by the law of England and Wales, we are not liable for indirect or consequential loss, or for loss of profits, revenue, goodwill or anticipated savings. Nor are we liable for loss caused by the records an organization enters, by the way an organization or its users use Paqad, or by events beyond our reasonable control.
Organizations should keep their own exports of any records they cannot afford to lose.
Each organization will compensate us for reasonable losses and costs arising from a claim by someone else because the organization entered or used personal data in Paqad unlawfully or broke these terms, to the extent that the organization is responsible.
An organization may stop using Paqad at any time by telling us. A user may ask their organization to end their access, or ask us to delete their account.
We may end an organization's use of Paqad if it seriously breaks these terms, or if we stop providing the service. Unless the law or a security risk prevents it, we will give the organization reasonable notice and time to export its records. After that we will delete its records, except anything we must keep by law; copies in the database history are removed as that history expires.
The parts of these terms that by their nature should continue — such as data ownership, liability and governing law — continue after use ends.
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute about them. If you are a consumer living elsewhere, you keep the protection of the mandatory laws of the country where you live.
We may update these terms. The date at the top shows when the current version took effect. If a change is significant, we will tell organizations before it takes effect. Continuing to use Paqad after that date means accepting the updated terms.
